Is this "the first argument" in English? Or even "the first claim"?? This is Belgian French and relates to a dispute concering an employment contract.

neutral  Nikki Scott-Despaigne: "To elaborate" can be usesd as a verb, but it can also be a false friend. I think that "to draw up" here works better, or perhaps evens "presented" or "sest out". More context would help.

Explanation:
The court isn't referring to what a US court would call "proof" in the sense of an evidentiary demonstration. Rather, the topic is what we would call the party's theory of the case, or here "the first theory" (among multiple theories, evidently).

Is the alleged sophistry the first theory, or the exposition thereof? A matter of opinion but I think the latter because robust sophistry requires that the flim-flam artist lay out an argument rather than just a simple proposition. So I think elaboration, or similar, is needed.
