قرار وزير العدل رقم 1087 لسنة 2000
بتحديد أماكن تنفيذ الأحكام برؤية الصغير والإجراءات الخاصة بتنفيذ الأحكام والقرارات الصادرة بتسليم الصغير او ضمه او رؤيته أو سكناه ومن يناط به ذلك
وزير العدل :
بعد الاطلاع على قانون تنظيم بعض أوضاع وإجراءات التقاضي فى مسائل الأحوال الشخصية الصادر بالقانون رقم 1 لسنة 2000
قــرر
مادة 1
تنفذ الأحكام والقرارات الصادرة بتسليم الصغير او ضمه او رؤيته او سكناه تطبيقا لأحكام المادتين 67 و69 من القانون رقم 1 لسنة 2000 بمراعاة الإجراءات المبينة فى المواد التالية.
مادة 2
يجرى تنفيذ والقرارات الصادرة بتسليم الصغير او ضمه او رؤيته او سكناه بمعرفة المحضر المختص بالمحكمة, فان حدثت مقاومة او امتناع وعدم استجابة للنصح والإرشاد, يرفع الأمر لقاضى التنفيذ ليأمر بالتنفيذ بالاستعانة بجهة الإدارة بالقوة الجبرية ان لزم الأمر, ويحرر الأخصائي الاجتماعي مذكرة تتضمن ملاحظاته ترفق بأوراق التنفيذ.
مادة 3
ويراعى فى جميع الأحوال ان تتم إجراءات التنفيذ ودخول المنازل وفقا لما يامر به قاضى التنفيذ, ويجوز إعادة التنفيذ بذات السند التنفيذي كلما اقتضى الحال ذلك على النحو المبين فى المادة 66 من القانون 1 لسنة 2000.
مادة 4
في حالة عدم اتفاق الحاضن أو من بيده الصغير والصادر لصالحه الحكم على المكان الذي يتم فيه رؤية الصغير, يكون للمحكمة ان تنتقى من الأماكن التالية للرؤية وفقا للحالة المعروضة عليها وبما يتناسب- قدر الإمكان- وظروف أطراف الخصومة, مع مراعاة ان يتوافر فى المكان ما يشيع الطمأنينة فى نفس الصغير ولا يكبد أطراف الخصومة مشقة لا تحتمل.

مادة 5
يجب ألا تقل مدة الرؤية عن ثلاث ساعات أسبوعيا فيما بين الساعة التاسعة صباحا والسابعة مساء, ويراعى قدر الإمكان ان يكون ذلك خلال العطلات الرسمية وبما لا يتعارض ومواعيد انتظام الصغير في دور التعليم.
مادة 6
ينفذ الحكم الصادر برؤية الصغير في المكان والزمان المبين بالحكم.
مادة 7
لأي من أطراف السند التنفيذي او يستعين بالأخصائي الاجتماعي المنتدب للعمل بدائرة المحكمة التى أصدرت حكم الرؤية لإثبات نكول الطرف الاخر عن التنفيذ فى المواعيد والاماكن المحددة بالحكم, ويرفع الأخصائي الاجتماعي تقريرا للمحكمة بذلك إذا ما اقام دعوى فى هذا الخصوص .
Translation - English Minister of Justice Order No. 1087 of 2000
Establishing locations for implementing provisions for child visitation, and establishing procedures concerning implementation of judgements and decisions related to child extradition, reunification, visitation, and housing, and those responsible for such.
The Minister of Justice,
Having considered a law regulating certain litigation conditions and procedures in matters of personal status issued in Law No. 1 of 2000,
Has ruled:
Article 1
Implementation of judgements and decisions related to child extradition, reunification, visitation, and housing in accordance with the provisions of articles 67 and 69 from Law No. 1 of 2000, taking into account the procedures set forth in the following articles.
Article 2
Decisions related to child extradition, reunification, visitation, and housing are being implemented by relevant court protocols. In the event of resistance or failure to respond to advice and guidance, the matter shall be referred to the enforcement judge to order the utilization of a governing task force if necessary. The social worker shall draw up a memorandum that shall include the social worker’s observations attached to the execution papers.
Article 3
In all cases care shall be taken that the procedures are implemented within the home as ordered by the enforcement judge, and may be implemented by the same executive order when required, as indicated in Article 66 of Law No. 1 of 2000.
Article 4
In the case of the failure of the child’s custodians or caretakers to agree on a location for child visitation that meets the best interests of the child, the court shall select from the following locations for visitation in accordance with the present state of affairs and in proportion, to the extent possible, the circumstances of the litigating parties, taking care that the location provides for the comfort of the child and does not inflict intolerable hardship upon the litigating parties:
• A sports or social club.
• A youth care center.
• A maternal and child welfare home that has a park.
• A public park.
Article 5
The length of the visitation should not be less than three hours weekly, between 9am and 7pm. Care shall be taken that, to the extent possible, visitations occur on public holidays so as not to interfere with the child’s school term.
Article 6
Judgement regarding child visitation shall be implemented at the place and time as indicated in the judgement.
Article 7
It is upon the parties who are associated with the executive order, or are drawing upon the services of the social worker appointed to work in the court that issued the visitation judgement, to prove the other party’s failure to meet at the times and locations specified in the judgement. The social worker shall file a report accordingly to the court, provided a complaint is filed in this regard.

ثانياً: السيد/ ___________ – مصري – مسلم الديانة – المقيم في ___ شارع الحديني محرم بك ويحمل بطاقة عائلية رقم______ سجل مدني محرم بك. "طرف ثاني مشتري"
البند الأول
باع أفراد الطرف الأول ضامنين متضامنين مع تحملهم بكافة الضمانات الفعلية والقانونية إلى الطرف الثاني القابل لذلك ماهو 560 متر مربع تقريباً عبارة عن جزء من مسطح أكبر كامل أرض ومباني العقار رقم ___ تنظيما وحاليا رقم ___ شارع بورسعيد بسبورتنج – قسم سيدي جابر – محافظة الاسكندرية والمكون بناؤه من دور أرضي (كانتين) وثلاثة أدوار علوية بكل دور شقة واحدة والمحدود بحدود أربعة وهي :
الحد البحري الغربي: العقار خلف ___ تنظيم وحاليا خلف رقم ___ شارع بورسعيد بطول 19.15 متر مربع.
الحد البحري الشرقي: العقار رقم ___ شارع بورسعيد بطول 28.90 متر مربع.
الحد القبلي الشرقي: شارع بورسعيد يطول 19.25 متر مربع.
الحد القبلي الغربي: العقار رقم ___ شارع بورسعيد بطول 29.50 متر مربع.
وهذه الحدود والأطوال تحت العجز والزيادة طبقا لكشف التحديد المساحي.
ويشمل هذا البيع الممر الفاصل بين العقار المبيع والعقار رقم ____ شارع بورسعيد وهذا الممر متروك لخدمة العقار المبيع والعقار خلفه (186 تنظيم وحالياً خلف رقم ____ ش بورسعيد) بالمرور والمطل.
البند الثاني
آلت الملكية إلى أفراد الطرف الأول منها حصة مقدارها 18 ط ثمانية عشرة قيراطاً بموجب عقد البيع المشهر بمكتب الشهر العقاري بالاسكندرية برقم ___ لسنة 1973م بتاريخ 4/10/1973 وحصة 6 ط ستة قيراطا آلت إليهم عن طريق الميراث الشرعي وتوزيعهم كالآتي:
3 قيراط عن والدتهم المرحومة ____________ والثابت وفاتها ووراثتها بموجب الإعلام الشرعي الصادر من محكمة المنتزه للأحوال الشخصية بتاريخ 21/9/1978م برقم ___ لسنة 1978م وراثات المنتزه و3 قيراط عن والدهم المرحوم ____________ والثابت وفاته ووراثته بموجب الإعلام الشرعي الصادر من محكمة المنتزه للأحوال الشخصية بتاريخ 14/10/1984م برقم ___ لسنة 84 وراثات المنتزة.
البند الثالث
تم هذا البيع بثمن إجمالي وجزافي مقداره 1.680.000 مليون وستمائة وثمانون ألف جنية دفع الطرف الثاني ليد أفراد الطرف الأول كل بحسب نصيبه وقت توقيع ذلك العقد مبلغ وقدره 1.612.000 مليون وستمائة واثني عشر ألف جنيه وبتوقيع أفراد الطرف الأول على هذا العقد يعتبر مخالصة تامة ونهائية باستلامه. والباقي ومقداره 68.000 ثمانية وستون ألف جنيه تحت يد الطرف الثاني لسدادا ضريبة التصرفات العقارية المستحقة على أفراد الطرف الأول البائعين التزم بسدادها الطرف الثاني وقت استحقاقها لمصلحة الشهر العقاري. وقد اتفق الطرفان على أنه في حاله زياده ذلك المبلغ أو نقصه فلا يجوز لأيهما مطالبة الآخر سواء بالزيادة أو النقصان. وبذلك يعتبر جميع الثمن قد تسدد بالكامل، ولا يحق لأي من الطرفين مطالبة الطرف الآخر بأي حقوق أية كانت.
البند الرابع
يقر الطرف الثاني المشتري بأنه قد عاين العقار المبيع المعاينة التامة النافية لكل جهالة وأنه قبل شراؤه بحالته التي هي عليها الآن ووضع يده عليه من الآن وأصبح المالك الوحيد للعقار موضوع التعامل له حق التصرف فيه كما يشاء من هدم و بناء واستخراج قرار الهدم وترخيص البناء باسمه.
البند الخامس
من المتفق عليه بين الطرفين على أن هذا العقد يشمل العقار ككل ___ (تنظيم سابقاً وحالياً ___ شارع بورسعيد) بحيث إذا ظهرت أي زيادة أو نقصان في مساحته أو حدوده لا يحق للطرفين مطالبة الطرف الآخر بثمن أو رد تلك الفروق.
البند السادس
يقر الطرف الثاني باستلامه العقار المبيع استلاما فعلياً ووضع يده عليه وأصبح المسئول عن كافة العوائد والضرائب المستحقة عليه بحي شرق الاسكندرية وغيرها وذلك اعتبارا من تاريخ تحرير هذا العقد أما قبل هذا التاريخ يلتزم به أفراد الطرف الأول.
البند السابع
هذا البيع بات نهائي لا يجوز لأي من الطرفين العدول عنه فإن تخلف أفراد الطرف الأول عن توقيع عقد البيع النهائي لشهره وتسجيله كان للطرف الثاني الحق في مقاضاتهم بإثبات وصحة ونفاذ هذا العقد بمصروفات يلتزمون بها.
البند الثامن
للطرف الثاني الحق في إدخال أي مشترين يرغب في الاشتراك معهم بالشراء.
البند التاسع
مصاريف تحرير هذا العقد وعقد البيع النهائي ورسوم شهره وتسجيله بما فيها ضريبة التصرفات المستحقة على الطرف الأول يلتزم بها الطرف الثاني دون مسئولية الطرف الأول عنها في شيء حيث تم استقطاعها من باقي الثمن.
البند العاشر
تختص محكمة الأسكندرية الإبتدائية بأي نزاع ينشأ بصدد تنفيذ هذا العقد أو بنداً من بنوده.
البند الحادي عشر
تحرر هذا العقد من ثمانية نسخ لكل طرف نسخة واحدة للعمل بموجبها عند اللزوم ونسخة لاتخاذ إجراءات الشهر العقاري بموجبها.

(First Party - Sellers)
Secondly – Mr. ________, Egyptian, Muslim, Resident of No. ____El-Heddini Street, District of Moharam Bek, Family ID No. ________, Moharam Bek Civil Registry.
(Second Party - Purchaser)
The First Article
The individuals of the First Party jointly and severally do hereby sell, with all the real and legal guarantees, to the Second Party, who hereby accepts, property which is approximately 560 meters square and is which is part of a larger lot that includes the land and building of the current property No. ____ (No. ____of the previous regime) of Port Said Street in (the neighborhood of) Sporting, District of Sidi Gabr, Governorate of Alexandria. The building consists of a ground floor (canteen) and three upper floors, each floor containing one flat, and is bordered by four borders which are:
The northwest border, which is adjacent to: The property behind the current No. ___ (No. ____ of the previous regime) of Port Said Street. Length: 19.15 meters.
The northeast border, which is adjacent to: The property No. ____ of Port Said Street. Length: 28.90 meters.
The southeast border, which is adjacent to: Port Said Street. Length: 19.25 meters.
The southwest border, which is adjacent to: The property No. ____ Port Said Street. Length: 29.50 meters.
These borders and lengths are subject to decrease and increase in accordance with the land survey. This sale includes the easement between the sale property and the property No. _____ of Port Said Street. This easement serves as a passage and an outlook, and is reserved for the sale property and the property behind it - the current No. ____ of Port Said Street (No. 186 of the previous regime).
The Second Article
The First Party individuals acquired ownership of a share of 18 (eighteen) metric units under the contract of sale No. ____, notarized by the Alexandria Land Registry Office in the year 1973 and dated 4 October 1973. The First Party individuals acquired ownership of an additional share of 6 (six) metric units by legitimate inheritance and is distributed as follows:
3 metric units from their late mother______. Her death and inheritance are established under Legal Notification No. ____ of 1978 – issued by the Personal Status Court of Montaza and dated 21 September 1978 Inheritance Department of the Montaza Court.
3 metric units from their deceased father _____. His death and inheritance are established under Legal Notification No. ____ of 1984 - issued by the Personal Status Court of Montaza and dated 14 October 1984 Inheritance Department of the Montaza Court.
The Third Article
This sale has been made in a lump sum totaling 1,680,000 (one million six hundred eighty thousand) pounds. The Second Party has paid the First Party individuals each according to his/her share at the time of signing of this contract the amount of 1,612,000 (one million six hundred twelve thousand) pounds. The signatures on this contract of the individuals of the First Party shall be considered a complete and final acceptance of receipt acknowledging payment. The remaining amount of 68,000 sixty-eight thousand pounds shall remain in the hands of the Second Party for repayment of accrued real estate obligations owed by the First Party Sellers that the Second Party shall pay when due to the Land Registry Office. The two parties have agreed that, in the event of an increase or decrease in these costs, neither of them may claim the increase or decrease against the other. In so doing it shall be deemed that the entire price has been paid in full. Neither party is entitled to claim any rights whatsoever against the other party.
The Fourth Article
The Second Party (Buyer) declares that the Second Party has fully and duly examined the sale property and has accepted its purchase “as is,” and has taken possession and become the sole owner of the property. The Second Party has the right to dispose of it as the Second Party pleases including demolition, construction, and obtaining a demolition order and a building permit in the Second Party’s name.
The Fifth Article
It is agreed between the two parties that this contract includes the property as a whole (the current No.____, No.____ of the previous regime, of Port Said Street) such that if any increase or decrease in its area or borders emerges neither of the parties has the right to claim payment or refund of those differences against the other party.
The Sixth Article
The Second Party acknowledges its effectual receipt of the sale property and has taken possession of it, and has become responsible for all the future revenues and taxes accruing due to the neighborhood of East Alexandria and others as of the drafting date of this contract. However the First Party will pay all that is due prior to this date.
The Seventh Article
This sale has become final and none of the parties may withdraw from it. If the First Party fails to sign the final contract of sale, and, thereby, fails to notarize and register the sale, then the Second Party has the right to make claim against the First Party with the proof, validity and enforcement of this contract for the expenses it incurs.
The Eighth Article
The Second Party has the right to bring in any buyers interested in purchasing with the Second Party.
The Ninth Article
The Second Party shall pay the expenses of drafting this contract and the final contract of sale, and shall pay the notarization and registration fees, including the outstanding transaction taxes owed by the First Party. The First Party has no further responsibility for these fees and taxes because they were deducted from the purchase price.
The Tenth Article
The Alexandria Lower Court shall have jurisdiction over any dispute arising in respect of implementing this contract or any of its articles.
The Eleventh Article
This contract has been drafted in eight copies; one copy per each party for action as needed, and one copy for the Land Registry to take action thereunder.

countries in my opinion are socially and emotionally healthier in many ways
than the countries that are trying to “develop” it. Why is this so? The desire to solve this puzzle, and to seek
answers to other related questions, has driven me to develop significant
regional knowledge, Arabic language ability, professional relationships, and
problem-solving skills throughout my career within the MENA region.
