Mediation is a non-adversarial procedure in which a neutral, specially trained professional (the mediator) assists the parties in reaching a settlement of a dispute or difference. The mediator avoids being judgmental, but rather employs approaches, which facilitate constructive and productive negotiations.
Throughout, the parties and their advisers remain in complete control and ultimately decide whether and how a case will be settled. In the event that the parties agree to settle, that settlement will be documented in a form, which will become binding and legally enforceable.
The mediation session normally begins with a joint meeting at which the parties summarise the respective positions and highlight key facts and issues. Thereafter the mediator conducts a series of private conferences and further joint meetings with each party during which the arguments, claims / defences, responses and settlement positions are discussed and analysed.
The parties are encouraged to consult with their legal and other advisers before and during the mediation and before finalising a settlement. The mediator at no time acts as legal adviser to any of the parties.
The Agreement
The undersigned parties hereby agree to participate in mediation in accordance with the following terms:
1. whilst it is recognised that mediation is a voluntary process and that the mediator will not and cannot compel the parties to settle, nor even to continue negotiating, the parties agree to participate in negotiations in good faith with the aim of achieving a settlement.
2. The parties agree to have present at the mediation such persons as are authorised to agree settlement terms.
3. The parties agree that every person involved in the mediation will keep confidential:
a. the fact that the mediation is to take place or has taken place other than to inform a court dealing with any litigation relating to the dispute of that fact;
and
b. all information, whether oral, written or otherwise, produced for or at the mediation, including the terms of any settlement agreement arising from it, provided that nothing in this clause prevents the parties (including the mediator) discussing the mediation with the parties' professional advisers and/or insurers, or any party or the mediator making disclosure to any relevant authority or person, whether under the Proceeds of Crime Act 2002* and/or under any Regulations relating thereto, if obliged to do so by law.
4. The parties agree that:
a. all offers, promises, conduct and statements made in the course of the mediation proceedings are inadmissible in evidence in any litigation or arbitration;
b. any agreement reached at or following the mediation shall not be binding on the parties unless it is recorded in writing and signed by the parties and/or their authorised representatives;
c. they will not call the mediator or any representative of [name of organisation providing the services of the mediator] as a witness, nor require the production of records or notes relating to the mediation;
d. no recording or transcript will be made at the time of the mediation.
Translation - Greek Η Συμφωνία
Με το παρόν, οι υπογράφοντες διάδικοι συμφωνούν να συμμετάσχουν στη διαμεσολάβηση σύμφωνα με τους ακόλουθους όρους:
4. παρότι αναγνωρίζουν ότι η διαμεσολάβηση αποτελεί εκούσια διαδικασία και ότι ο διαμεσολαβητής δεν είναι σε θέση και δεν πρόκειται να αναγκάσει τους διαδίκους να επιτύχουν διακανονισμό ή ακόμη και να συνεχίσουν τις διαπραγματεύσεις, οι διάδικοι συμφωνούν να συμμετάσχουν στις διαπραγματεύσεις καλόπιστα και με σκοπό την επίτευξη διακανονισμού.
5. Οι διάδικοι συμφωνούν να έχουν παρόντα στη διαμεσολάβηση άτομα στα οποία έχει δοθεί η δικαιοδοσία να συμφωνήσουν σχετικά τους όρους του διακανονισμού.
6. Οι διάδικοι συμφωνούν ότι κάθε πρόσωπο που εμπλέκεται στη διαμεσολάβηση θα κρατήσει εμπιστευτικά τα ακόλουθα:
α. το γεγονός ότι πρόκειται να λάβει χώρα ή έχει λάβει χώρα η διαμεσολάβηση, πέραν του να ενημερώσουν οποιοδήποτε δικαστήριο που ασχολείται με ένδικη διαφορά η οποία να αφορά στην αμφισβήτηση του εν λόγω γεγονότος
και
β. κάθε πληροφορία, είτε προφορική είτε έγγραφη είτε άλλης μορφής, η οποία δόθηκε για τους σκοπούς της διαμεσολάβησης ή στη διαδικασία της διαμεσολάβησης, συμπεριλαμβανομένων των όρων οποιουδήποτε διακανονισμού προκύψει από τη διαμεσολάβηση, υπό τον όρο ότι καμία ρήτρα του διακανονισμού δεν εμποδίζει τους διαδίκους (συμπεριλαμβανομένου του διαμεσολαβητή) που συζητούν για τη διαμεσολάβηση με τους επαγγελματίες συμβούλους και/ή ασφαλιστές των διαδίκων ή οποιοδήποτε άλλο διάδικο ή τον διαμεσολαβητή να αποκαλύψουν πληροφορείς σε οποιαδήποτε σχετική αρχή ή πρόσωπο, είτε βάσει του νόμου 2002 για τα κέρδη από εγκληματική δραστηριότητα είτε βάσει οποιωνδήποτε σχετικών κανονισμών αφορούν σε αυτόν, εφόσον το επιτάσσει ο νόμος.

β. οποιαδήποτε συμφωνία επιτευχθεί στη διαδικασία ή μετά από αυτήν, δεν θα είναι δεσμευτική για τους διαδίκους, εκτός εάν καταγραφεί εγγράφως από τους διαδίκους και/ή τους πληρεξούσιους εκπροσώπους τους
γ. δεν θα καλέσουν τον διαμεσολαβητή ή οποιονδήποτε άλλο εκπρόσωπο του [αναφέρετε τον οργανισμό του παρέχει τις υπηρεσίες διαμεσολάβησης] ως μάρτυρα, ούτε θα απαιτήσουν την αναπαραγωγή πρακτικών ή σημειώσεων σχετικών με τη διαμεσολάβηση

(1) Zu dem Rechtszug oder dem Verfahren gehören auch alle Vorbereitungs-, Neben- und Abwicklungstätigkeiten und solche Verfahren, die mit dem Rechtszug oder Verfahren zusammenhängen, wenn die Tätigkeit nicht nach § 18 eine besondere Angelegenheit ist. Hierzu gehören insbesondere 1. die Vorbereitung der Klage, des Antrags oder der Rechtsverteidigung, soweit kein besonderes gerichtliches oder behördliches Verfahren stattfindet; 2. außergerichtliche Verhandlungen; 3. (2) Zu den in § 18 Abs. 1 Nr. 1 und 2 genannten Verfahren gehören ferner insbesondere 1. gerichtliche Anordnungen nach § 758a der Zivilprozessordnung sowie Beschlüsse nach den §§ 90 und 91 Abs. 1 des Gesetzes über das Verfahren in Familiensachen und in den Angelegenheiten der freiwilligen Gerichtsbarkeit, 2. die Erinnerung nach § 766 der Zivilprozessordnung, 3. die Bestimmung eines Gerichtsvollziehers (§ 827 Abs. 1 und § 854 Abs. 1 der Zivilprozessordnung) oder eines Sequesters (§§ 848 und 855 der Zivilprozessordnung), 4. die Anzeige der Absicht, die Zwangsvollstreckung gegen eine juristische Person des öffentlichen Rechts zu betreiben, 5. die einer Verurteilung vorausgehende Androhung von Ordnungsgeld und 6. die Aufhebung einer Vollstreckungsmaßnahme.
