I found the phrase in the employment law. The context of hiring people for a job.

Ne samo na osnovu pola. Opsta ideja je da su to slucajevi kada poslodavac ne mora da primenjuje zakone koji sprecavaju diskriminaciju. Normalno je zabranjeno (i kazne nisu nimalo naivne) oglasavati posao "samo za zene" "samo za muskarce" "samo za belce" "samo za zgodne zene" "samo za visoke muskarce" "hocemo samo kandidate od 30 do 40 godina" i sl.
Ovo su slucajevi kada se smatra opravdanim sprovoditi diskriminaciju koja je inace zabranjena.
Jedno od cudnijih izuzeca predstavljaju agencije za zaposljavanje koje nude poslove u nekim arapskim zemljama, i kojima je dopusteno da traze parove koji su braku, i to izricito "married to each other".

Ali ne mora samo na osnovu pola, mogu biti i drugi faktori kao što su godine, rasna pripadnost (recimo u kineskom restoranu se traži kuvar koji je Kinez), verska pripadnost itd.

To bi bila kvalifikakovanost za posao na osnovu pola, ali ne znam da li stvarno kod nas postoji takva definicija.

Occupational qualifications bi trebalo da su profesionalne kvalifikacije. Nisam siguran kako tu uklopiti ovo genuine..

"genuine occupational qualifications" describe cases when employers are exempt from anti-discrimination laws.

--"qualification" here means the "qualities" of the person required for a specific job. The "qualities" in question are those that normally can not be taken in consideration when employing people - gender, age, race, marital status, sexual orientation.

--"occupational" - requirements applying to a specific occupation / a particular job

--"genuine" - the opposite of fake / pretended / false, meaning there must be a real need to employ only a married couple, or only a men or a women etc.., or someone of a specific race, or someone speaking a specific language...

"There are eight possible types of reason for claiming a GOQ in advertising a particular job:

Physiology or authenticity (for example, in choosing actors to play a role),
Privacy and decency of people the employee would be dealing with (for example, staff in a care home),
Private household's integrity (for example, professional carers for an individual, but not normally nannies),

Single-sex establishments, for example special prisons and refuges,

The only difference seems to be that there is defined list of "Genuine Occupational Qualifications" while "Genuine Occupational Requirements" can be argued on a case by case basis by the employer.

Ovo je definicija iz rečnika za pojam occupational:

Occupational - Of, relating to, or caused by engagement in a particular occupation: occupational hazards.

Adj. 1. occupational - of or relating to the activity or business for which you are trained

National Vocational Qualifications (NVQs) and Scottish Vocational Qualifications (SVQs) are occupational qualifications. They are work-related and competence based, and develop skills and competencies that are needed to do a particular job.

It may be lawful for you as an employer to treat people differently when recruiting. In very limited circumstances, if you can show that someone with a particular protected characteristic (on grounds of age, disability, gender reassignment, marriage and civil partnership, race, religion/belief, sex or sexual orientation) is central to a particular job, then you can insist that only someone who has that particular protected characteristic is suitable for the job. This would be a genuine ‘occupational requirement’ (GOR). There is no definitive list of situations where a GOR will exist. It is therefore always best to take legal advice before advertising the job if you believe that there is a GOR.
