This is generally in the passive voice as in the extract you quote. So it is more likely to appear as "annexed hereto after being referred to". If it is a legal document then you need to use the appropriate language. An annex is not just something attached to the document, it is integral to it.

I believe the reason for the wording is that the document concerned is not annexed to the main document at the time of writing. Probably this is because it needs to be referred to separately at the time of signing and is later clipped on by the notaire's secretary - the notaire being far too important to operate a stapler.

neutral Vicky James : I agree with your logic, it's just that this is such a standard phrase in French that I'm not sure "after being referred to" would be used as an equivalent. I realise that my suggestion has basically left it out :-)

You could be right, though there might be a problem in that case with the signatories signing a document that claimed to include an annex that wasn't actually attached at the time of signing.

Si vous recevez un document en disant: annexer apres mention, c'est plutot une solicitation. Donc "required" va bien ^^

Ok, before you all shout, I realise you can use annex, too, but still think appendix better.

neutral B D Finch : Appendix for e.g. a book, where it is supplementary info. Annex for a legal document where it is integral to the document.
