Conferma la sentenza emessa dal ...ed appellata da XXX, che condanna al pagamento delle spese del procedimento.

Scusate, ma ho un dubbio soprattutto sul "che".

Does uphold the judg(e)ment...., that (which) orders / awards

al pagamento delle spese del procedimento: payment of the costs of the proceedings ('the costs in the summons').

again, query whether civil, criminal (following sentencing) or administrative.

Stylistically, 1. does uphold or - simply - upholds for the 'Plain Legal English' campaigners and

2. I would use 'that' for 'che', the English grammatical point being that (,) which is sometimes claimed to refer back to the whole of the main clause and not just an individual word or lexical 'item'.
