GHANIPOUR Zahra position and subsidiary claim,

GHANIPOUR Zahra disputes the claim in principle. She believes that there can be no question of the marriage being dissolved on the basis of Belgian law. The settlement and division of the marital community can also not take place according to Belgian law, given the marriage contract in Iran. If they do not divorce according to Iranian law, then, according to the defendant, the man can remarry, since Muslims can be married to multiple women, while she herself could never start her life again with another man. In essence, she requests that the claim be dismissed as unfounded.

In her statement lodged at the registry on 08.10.2018, GHANIPOUR Zahra initiated, in a subsidiary order, an ancillary claim to obtain a monthly personal maintenance allowance after divorce of EUR 750.00, indexable annually for the duration of the marriage.

The parties agree to further enable the ancillary claim and request conclusion periods.
