The Frenchisee accepts that the remedies available to it which are not affected by the set off/deduction provisions of this agreement are sufficient for its purposes including, as they do, a right to sue for damages and if appropriate acceptance of any repudiatory conduct on the part of the Franchisee.
Pursuing an unjustifiable course of action in relation to a contractual obligation, or adopting an incorrect interpretation of a contract, may amount to repudiatory conduct even if it is honestly believed that the action pursued or the interpretation adopted is correct.
