Discussion

Charles Ek Jul 10, 2014:
While practicing law for five years, I have never come across the equivalent Latin term. :-) YMMV over there.
Diarmuid Kennan (asker) Jul 10, 2014:
Forum rei sitae? While searching for the translation of this term, I have come to the conclusion that the equivalent Latin term is almost certainly either "Forum arresti" or "Forum rei sitae", probably the latter.

Peer comment(s):

disagree Charles Ek : Among the things I learned as a law student is that citing and quoting verbatim the statement of another law student as an authority on anything is a dubious practice at best.Especially when that law student offers no authority for his own use of the term

This goes back to Chapter 10, Section 3 of the Swedish Code of Judicial Procedure:

Lex fori (Latin for the laws of a forum) is a legal term used in the conflict of laws used to refer to the laws of the jurisdiction in which a legal action is brought.[1]

So it seems to be that the bank has based its case on arguments better suited to another jurisdiction (not tingsrätten)
Peer comment(s):

disagree Charles Ek : The Swedish term has to do with where a case can be heard, not which law will be applied by a particular court.
