This is from a contract for mechanical equipment, between a Chinese buyer and a French manufacturer. The contract is in Chinese and English. Can anybody see a subtle difference? Or shall I simply say "garantie"? Note that the verb forms too of the terms are used in the text.
**GUARANTEE AND WARRANTY**
Equipments:
The Seller expressly guarantees and warrants all goods to be free from defect in design, materials and workmanship and to conform strictly to the approved specifications and drawings. The material proposed will be complying with the laws, decrees and regulations in force, so as with the European rules, notably concerning the safety standards
All Seller service and repairs work resulting from Seller furnished defective or nonconforming goods or the replacement thereof shall be performed promptly and at the convenience of the Buyer. The replacement or repair works costs of the defective goods shall be borne by the Seller given that the equipments will be returned by the Buyer to the Seller’s workshop.

J'avoue que j'ai dû faire une recherche lorsque j'ai rencontré ces deux termes l'un près de l'autre la première fois : un notaire m'a confirmé la réponse.

The meaning is the same, the difference could be on specific time term i.e the suplier guarantees for a period of warranty. In english actually they are synonims. In french is the same as you say simply "garantie", but is synonim with "assurer". You can place them both in the context.

Je crois connaître la différence, car elle est très claire en allemand où elle se traduit par deux mots distincts. Je me permets de vous donner quelques lignes en allemand :-)

warranty • noun: (pl. warranties) 1 a written guarantee promising to repair or replace an article if necessary within a specified period.
guarantee • noun: 1 a formal assurance that certain conditions will be fulfilled, especially that a product will be of a specified quality.
Actually the error here is that most native speakers use them interchangeably and it has nothing to do with British, American or any other type of English.
'Warranty' has a time limit, e.g. for 12 months... and may be extendable to 24, 36 or 48 months for example.]
'Guarantee' is to a standard of quality and is not time bound... and is non-extendable.
However, we are all familiar with 'Lifetime Guarantee' claims by manufacturers... which of course are non-extendable by their very definition... ]
Found by googling G. & W. difference. As to the French, I'm unable to suggest anything.
