This is information that is capable of being protected, which in this context, seems to be by intellectual property rights. Nevertheless,the sense of the term includes capability of being protected, hence the term protectable is called for.

I do not think that there is a way around. Schutzrecht is an industrial design, not intellectual property

neutral Maureen Holm, J.D., LL.M. : Could be trade secrets (customer lists, buying preferences, etc.). The "registrable" business goes too far, too narrow.

Why does it say Schutzrecht then? A Schutzrecht happens to be an industrial design. Then the German is to be questioned.

That's what I would say to make the sentence run better ("confidential and/or proprietary information received"), and because this covers information that is "schutzrechtfähig" in this context.
If you want to stick closer to the text, you could say "information received that is subject to protection" (but I prefer the first option).

This is, admittedly, more of a comment/question on usage than an answer, but would it be copyrightable in such a context?
