Verfassungswidrig – verfassungswidriger- am...? Makes one wonder how many degrees of verfassungswidrig you can possibly have considering that both the Untermaß and Obermaß are already verfassungswidrig, according to this sentence.

As substandard is an adjective (oh dear!), I would revise my version:
must comply with the constitution to the letter.
Much less wordy, much more freely translated, yet covers the meaning.
