I'm not clear what this means or how to put it into legal English.

You don't need to say 'at a rate', and while "maggiorato' does mean 'above', it can be expressed more simply in English as 'a 25% penalty'.

Better avoid the term of art of a contract penalty to keep the clause alive in Anglo-Am. contract law. Otherwise, void on the face of it : prima facie in L.atin.

dovesse vs. si dovesse : conditional or subjunctive mood, so surely has a subject, namely the defaulting party; party in breach or *non-innocent* party.
